Vape Imports – Changes to Import Laws

6/3/2024

From 1 January 2024, single-use disposable vapes have become a prohibited item under Regulation 5A of the Customs (Prohibited Imports) Regulations 1956, unless they are subject to an exemption or are covered by a permit issued by the Office of Drug Control within Department of Health and Aged Care. This means any cargo containing disposable vapes detected by the Australian Border Force without a permit, will be seized.

From 1 March 2024, additional legislation has taken effect that makes reusable vapes and all other vaping products a prohibited item under Regulation 5A of the Customs (Prohibited Imports) Regulations 1956, unless they are subject to an exemption or are covered by a permit issued by the Office of Drug Control within Department of Health and Aged Care. Vaping products include devices, vaping accessories, vaping substances and all liquid nicotine.

From 1 March 2024, any vapes, or vape products entering Australia (without the required permit) will be seized and destroyed by the Australian Border Force (ABF).
